Importing Articles of apparel and clothing accessories, not knitted or crocheted from Kenya into Australia (2026)

No Australia-Kenya FTA exists so all woven apparel and clothing accessories attract MFN general tariff rates; the most critical compliance obligation is ensuring every garment carries correct AS/NZS 1957 care labelling and accurate country-of-origin markings under the Australian Consumer Law before shipment departs Nairobi.

No FTA — MFN rates applyHS Chapter 62

Compliance requirements

  • Verify each garment carries compliant AS/NZS 1957 care labels with correct 'Made in Kenya' country-of-origin marking before loading.
  • Confirm MFN tariff classification at the 8-digit level for each HS 62 line to calculate accurate landed duty costs.
  • If importing hi-visibility workwear, obtain AS/NZS 4602.1 and 1906.4 compliance evidence from the Kenyan manufacturer prior to order placement.
  • Australia has active anti-dumping measures on certain woven apparel from China and other countries — check the Anti-Dumping Commission's public register before placing orders as additional dumping duties can significantly alter landed cost
  • All garments must comply with mandatory AS/NZS care labelling standards (AS/NZS 1957) and country-of-origin labelling requirements under the Australian Consumer Law — mislabelled goods can be seized or face penalties
  • Hi-visibility garments for workplace use must comply with AS/NZS 4602.1 and 1906.4 — non-compliant workwear may be rejected by end customers in regulated industries such as mining and construction
  • Garments treated with flame retardants, antimicrobial finishes or other chemical treatments may require assessment under the Industrial Chemicals Act 2019 (AICIS) if the chemical is not on the Inventory — verify introducer obligations before importing
  • Goods containing animal-derived components (e.g. down fill, wool trims, leather patches) may attract DAFF biosecurity documentation requirements — ensure export health certificates or treatment declarations accompany consignments where applicable
  • No FTA exists between Australia and Kenya so MFN general tariff rates apply to all goods; a standard commercial invoice and packing list are required but no preferential certificate of origin is needed
  • Biosecurity Australia imposes strict import conditions on Kenyan agricultural products including cut flowers, fresh produce, plant material and hides - import permits and offshore treatment or inspection on arrival at an Australian first port of entry are commonly required under the Biosecurity Act 2015
  • Tea, coffee and food products from Kenya must comply with the Australia New Zealand Food Standards Code including labelling, permitted additives and contaminant limits; the Department of Agriculture may conduct documentary and physical checks under AQIS protocols
  • Leather and animal-derived products such as hides and skins require an import permit and may be subject to treatment requirements to address pest and disease risk; wooden packaging must comply with ISPM 15 heat treatment and marking standards or face rejection at the border

Key documents required

  • commercial invoice with full fabric composition (fibre type and percentage) and country of origin clearly stated
  • bill of lading or airway bill
  • packing list with individual garment quantities and sizes
  • certificate of origin (e.g. Form E for ChAFTA, AANZ Form for AANZFTA) to claim preferential tariff rates
  • care labelling compliance declaration or test report confirming AS/NZS 1957 and relevant safety standards for workwear

Import tip

Always declare fibre composition at the subheading level on your import entry — ABF routinely queries Chapter 62 classifications where the fabric mix determines the correct 6- or 8-digit tariff code, and providing lab test reports upfront avoids costly holding delays at the border.
